What is justice?

Put simply, justice in any given situation is about fair treatment for all concerned.

It is about balancing the interests of the individual against the needs of society, or balancing the interests of one individual against another.

The concept of justice comes into play whenever there is a conflict of interests between two parties, when one party’s wellbeing, freedom or rights are being impacted by the actions of another party. Justice requires consideration of the needs of both parties.

To balance the needs of both sides, we first need to understand who are the individuals and what exactly are their needs. We need to look at each party’s cognitive, social and emotional needs, as well as their physical needs.

Generally speaking, wherever unnecessary desires, ambition or wants impact another party’s physical wellbeing or even threaten their life, it tends to be a cut-and-dried case. It’s generally agreed that loss of life or personal injury of one party will almost always outweigh the whims or unnecessary desires of the other party. The needs of both sides are weighed and balanced against each other and, at least in theory, considered equally.
